Thank you for using the Rendershop platform. Rendershop is a product of Two Cases, LLC. These Terms of Service (“Terms”) govern the relationship between Rendershop (“Rendershop,” “we,” “our”) and the individual or entity (“Customer,” “You,” “Your”) using or accessing our services, applications, or platform through our website available at rendershop.ai (the “Site”), or by any other means (collectively, the “Services”). These Terms explain your rights regarding designs, renders, videos, and other outputs you generate using the Service (the “Assets”), any inputs you provide including images, text prompts, sketches, CAD drawings, floor plans, PDFs, and other files (the “Inputs”), your use of the Services, and other important topics such as arbitration. Our Privacy Policy outlines how we handle your data.
Please carefully review these Terms, along with our Privacy Policy and all other documents referenced in these Terms, including any Subscription Plans. Together with these Terms, these documents form a single, binding agreement between us (the “Agreement”). This Agreement is effective when the Customer is presented with this Agreement and proceeds to use or access the Services (the “Effective Date”). We may update this Agreement from time to time, and continued use of the Services constitutes acceptance of the updated Terms. If You do not agree to this Agreement, please stop using the Services immediately.
By accessing and using Rendershop, You agree to comply with and be bound by these Terms of Service. These Terms outline the rules and obligations that govern Your use of our platform. By agreeing, You affirm that You have read, understood, and accepted these Terms as a binding agreement. Your acceptance also signifies Your agreement to our Privacy Policy and Subscription Plans. We reserve the right to deny access to the Services to any individual or entity that fails to comply with these Terms. Please use Rendershop responsibly and in accordance with the purpose of the platform to ensure a positive experience for all users.
Rendershop provides an advanced AI-powered solution for reimagining and rendering visual spaces, architecture, and design concepts. The Services include, but are not limited to: AI-generated rendering of architectural designs, sketches, and elevations; image editing and re-texturing; photo enhancement and upscaling; virtual staging of interior spaces; AI-powered video walkthroughs and cinematic presentations; and inpainting and object removal. By providing images, PDFs, sketches, or text prompts, Rendershop empowers you to transform and visualize environments effortlessly. Our platform is a creative visualization tool intended to inspire and streamline the design process for building design professionals and enthusiasts.
THE SERVICES AND ALL ASSETS GENERATED BY RENDERSHOP ARE FOR VISUALIZATION AND CONCEPTUAL PURPOSES ONLY. They do not constitute and must not be used as a substitute for professional architectural plans, structural engineering calculations, building code compliance assessments, construction documents, or any other licensed professional services. You must not rely on AI-generated Assets for decisions involving structural integrity, life safety, fire egress, load-bearing capacity, zoning compliance, mechanical or electrical systems design, ADA compliance, energy code compliance, or any matter requiring licensed professional certification or a stamped drawing.
AI-generated renders may contain visual inaccuracies, physically impossible structures, non-compliant spatial relationships, or materials depicted in ways that do not reflect real-world performance. Rendershop expressly disclaims all liability for any loss, damage, property damage, personal injury, or death arising from any reliance on AI-generated Assets for construction, permitting, bidding, building-code compliance, or any real-world building activity. All Assets should be reviewed and validated by a licensed architect, engineer, or other qualified professional before being used in any professional or construction context.
We are constantly improving the Services. The Services are subject to modification, including the design styles of Assets, the underlying machine learning algorithms, and available features. No guarantees are made regarding the Services' quality, stability, uptime, or reliability. Both the Services and the Assets are provided on an “AS IS” BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, either express or implied, including title, non-infringement, or fitness for a particular purpose. You assume all risks associated with the use of the Services. We reserve the right to suspend or ban Your access at any time. You may not use the Services to develop competitive products, reverse engineer the platform, or use automated tools to interact with the Site.
Rendershop reserves the right to modify, suspend, or discontinue any part of the Services at any time, including the addition or removal of specific tools, rendering styles, AI models, or features. Where practicable, we will provide at least thirty (30) days' advance notice before discontinuing a material feature relied upon by paid subscribers. If a material change substantially diminishes the value of a paid subscription, the affected subscriber may cancel their subscription and receive a pro-rata credit for the unused portion of their current billing period. Changes to AI models or rendering algorithms that alter the style, quality, or characteristics of output do not constitute a material diminishment of service.
By accessing the Services, You confirm that You are at least 13 years old and meet the minimum age of digital consent in Your country. Paid subscription plans are available only to individuals who are at least 18 years of age or the age of legal majority in their jurisdiction, whichever is greater. If You are between 13 and 18 years of age, You may use the free tier of the Services only with the consent of Your parent or legal guardian, who must agree to these Terms on Your behalf and is responsible for Your activity on the Services. Because Assets are generated by AI based on user inputs, unexpected outcomes may occur. We encourage parents and guardians to monitor their children's use of the platform.
You agree to use the Services only for lawful purposes and in accordance with these Terms. You shall not use the Services to:
Violation of this Acceptable Use Policy may result in immediate suspension or termination of Your account, forfeiture of unused credits, and, where applicable, referral to law enforcement authorities. We reserve the right to remove any content that violates these Terms without prior notice.
Subject to your compliance with this Agreement, you own all Assets You create with the Services to the fullest extent permitted by applicable law. This includes AI-generated images, enhanced images, staged scenes, and video outputs. However, You grant Rendershop a perpetual, worldwide, non-exclusive, sublicensable, royalty-free, irrevocable license to use, reproduce, modify, and display the Inputs You provide and the Assets You produce for the purposes of operating, promoting, and improving the Services. This includes using data to train and refine our rendering algorithms, subject to any opt-out features provided in your account settings. You are solely responsible for ensuring you have the necessary rights to any images, drawings, plans, or other files you upload to the platform.
We understand that building design professionals may upload proprietary, unreleased, or client-confidential architectural designs, floor plans, elevations, and project materials to the Services. Rendershop will treat all Inputs uploaded to the platform as confidential information and will not publicly display, publish, or share identifiable project materials without Your express written consent.
Access to uploaded Inputs within our organization is restricted to personnel and automated systems necessary to provide, maintain, and improve the Services. The license granted to Rendershop under the Content Rights and Licensing section does not authorize us to feature, showcase, or publicly attribute Your specific project materials in marketing, portfolios, or case studies without Your prior written consent. If You have opted out of model training through your account settings, Your Inputs will not be used to train or fine-tune our AI models, though they will still be processed as necessary to generate Your requested Assets.
Rendershop respects the intellectual property rights of others and expects users to do the same. If You believe that content available through the Services infringes Your copyright or other intellectual property rights, You may submit a notice to our designated agent in accordance with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512. Upon receipt of a valid DMCA notice, we will promptly remove or disable access to the allegedly infringing material and notify the user who uploaded it. The affected user may submit a counter-notice if they believe the removal was made in error. Rendershop maintains a policy of terminating the accounts of users who are repeat infringers in appropriate circumstances.
Access to the Services is governed by a credit-based system. Each subscription tier provides a monthly allocation of credits. Credits are consumed when You use the Services to generate, edit, enhance, stage, or otherwise process Assets. The number of credits consumed varies by tool and operation. Current credit costs per operation are published on our pricing page and are subject to change. We will provide at least fourteen (14) days' advance notice before increasing credit costs for existing subscribers.
Unused credits do not roll over between billing cycles and expire at the end of each billing period. Credits have no cash value and are non-transferable. All credits consumed by a generation or processing operation are final and non-refundable, regardless of whether the operation completes successfully or fails. Credits consumed for operations that produce results You are dissatisfied with are likewise non-refundable.
We may invoice You through third-party payment providers such as Stripe. All purchases and subscription fees are final and non-refundable, except as expressly provided in the Changes to Service section or as required by applicable law. By subscribing, You acknowledge that no refunds or credits will be provided for partial use, dissatisfaction with AI-generated results, or technical issues on Your end. You may cancel Your subscription at any time, but access will continue at Your current tier only until the end of the current paid billing period, after which Your account will revert to the free tier. Initiating a chargeback or payment dispute without first contacting us at info@rendershop.ai to attempt resolution may result in immediate suspension of Your account pending investigation and, if the chargeback is determined to be fraudulent or unjustified, termination of Your account.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RENDERSHOP WILL NOT BE LIABLE TO YOU FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, OR FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES, INCLUDING BUT NOT LIMITED TO DAMAGES ARISING FROM RELIANCE ON AI-GENERATED ASSETS FOR CONSTRUCTION, DESIGN, OR BUILDING DECISIONS. Our aggregate liability for all claims arising out of or relating to these Terms or the Services will not exceed the total amount You paid to Rendershop for the Services during the twelve (12) months immediately preceding the event giving rise to the claim.
You agree to indemnify, defend, and hold Rendershop and its officers, directors, employees, agents, and affiliates harmless from and against any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) Your use of the Assets, including any reliance on Assets for construction or building purposes; (b) Your violation of these Terms or the Acceptable Use Policy; (c) Your infringement of any third-party intellectual property or other rights; or (d) any content You upload to the Services. Your aggregate indemnification obligation under this section shall not exceed the greater of (i) the total amount You paid to Rendershop during the twelve (12) months preceding the claim, or (ii) one thousand dollars ($1,000 USD).
Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or validity thereof, will be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) in accordance with its Commercial Arbitration Rules then in effect. The arbitration will take place in Wayne County, Michigan. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Each party shall bear its own costs and attorneys' fees, unless the arbitrator determines that a party's claims or defenses were frivolous, in which case the arbitrator may award reasonable attorneys' fees to the prevailing party.
BOTH PARTIES WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. You agree that any arbitration will be conducted on an individual basis and not as a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, both parties waive the right to a jury trial.
This Agreement is governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of laws principles. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Wayne County, Michigan, and You consent to the personal jurisdiction of such courts.
Rendershop may suspend or terminate your access to the Services at any time, with or without notice, for failure to comply with these Terms, violation of the Acceptable Use Policy, or for any other reason at our sole discretion.
You may terminate your account at any time via the Site settings. Upon voluntary termination by You, or upon termination by us for reasons other than a material breach of the Acceptable Use Policy, You will have thirty (30) days from the date of termination to download or export Your Inputs and Assets stored on the platform. After this 30-day retrieval period, we may permanently delete all data associated with Your account, including uploaded files, project data, and generated Assets.
If Your account is terminated for a material violation of the Acceptable Use Policy, including but not limited to fraud, IP infringement, or illegal activity, we reserve the right to delete Your data immediately without providing a retrieval period.
Upon termination, all licenses granted to You under these Terms shall immediately cease. The following sections shall survive termination: Content Rights and Licensing, Confidentiality of Uploaded Content, Limitation of Liability and Indemnity, Dispute Resolution, and this Termination section.
Rendershop shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemic, epidemic, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, flood, earthquake, accident, labor disputes or shortages, power or telecommunications failures, internet or cloud service provider outages, disruptions to third-party AI model providers or GPU compute infrastructure upon which the Services depend, changes in applicable law or government regulation, or cyberattacks. During any period of force majeure, our obligations under these Terms will be suspended to the extent affected, and the time for performance will be extended by a period equal to the duration of the force majeure event. We will make commercially reasonable efforts to resume performance as soon as practicable and to notify affected users of significant service disruptions.
